If you have questions about your rights as a renter or are having problems with your landlord, then there are several terrific sources of reliable information available:
  • The Federation of Metro Tenant Associations (FMTA) is a renter advocacy organisation here in Toronto that has many experts who can answer your questions either by telephone (416-921-9494), postal-mail, or e-mail (hotline@torontotenants.org).

  • If you have questions about hearings at the Landlord and Tenant Board (LTB), either because you or your landlord has scheduled a hearing or you are considering filing a complaint (“tenant application”) at the LTB, there are lawyers and community legal workers who can help. There is no cost for their service. These Tenant Duty Counsel advisors are available at most LTB offices (COVID permitting), and are also available to speak with by telephone.

  • You can also speak with a layer at your local Community Legal Clinic (CLC) office. Your local CLC can provide you with legal advice or connect you with legal representation. Each CLC office services a specific area of the city; check their webpage for more information. It is usually best to visit during one of their “Drop In” times, if they have them. You can try telephoning, but these are busy offices, so it is usually faster to drop in than to call. You can find the CLC office that services your area by following this link.

Rent Freezes End – Rent can now be raised again in Ontario...

The rent freeze is over.

Lots of us received the N1 "Notice of Rent Increase" forms from our landlords back in September of 2021, so that they would come into effect on January 1st.  Happy New Year! :-(

The capitalist exploitation of what should be a basic human right continues.

Probably like many people, my rent went up 1.2% in on Jan 1, 2022. Then new owners took over my apt building in March, and just today I received an N1 notice for another 1.2% increase to take effect in August 2022. That's not allowed, right? I'm not aware of any exceptions that might apply (not a new tenant, not a new building, etc.)

Hi Jack,

Two rent increases within 12 months is definitely not legal under most circumstances.

See section 120 of the Residential Tenancies Act, which states:

Guideline increase

120 (1) No landlord may increase the rent charged to a tenant, or to an assignee under section 95, during the term of their tenancy by more than the guideline, except in accordance with section 126 or 127 or an agreement under section 121 or 123.  2006, c. 17, s. 120 (1).

There is an exception to this rule, for example, if your landlord has provided you with an “Additional Service” (did you ask for a new parking spot, or storage locker, or something?),

Thanks. I actually contacted the management company a few days ago and resolved the issue. They said they were unaware of my previous rent increase from Jan 2022 (under the previous owners) and that I should disregard this recent N1. Seems odd that they wouldn't have a record of such things in files inherited from the previous owner company, but there we are. Glad I don't have to deal with it.
